210. ALLGEMEINE REGELN DES VÖLKERRECHTS (Art.25 GG)

[a] Völkergewohnheitsrecht kann nach Art.25 GG nur insoweit Bestandteil der innerstaatlichen Rechtsordnung sein, als es nicht dem Verfassungsrecht widerspricht.

[b] Art.25 GG bezieht sich nicht unmittelbar auf völkerrechtliche Verträge; diese werden nur auf der Grundlage eines Zustimmungsgesetzes Bestandteil der innerstaatlichen Rechtsordnung.

[a] By virtue of Art.25 of the Basic Law, customary international law is an integral part of municipal law only insofar as it is not in conflict with constitutional law.

|
|
[b] Art.25 of the Basic Law does not directly refer to international treaties, which become an integral part of municipal law only by virtue of an act of assent of the legislature.
