The Kenyan Court of Appeal in the BBI Judgements

On 20th August 2020, the Kenyan Court of Appeal in a landmark decision declared the Building Bridges Initiative (BBI), a large scale constitutional reform at the heart of President Uhuru Kenyatta political agenda, as unconstitutional. The decision has been overwhelmingly welcomed by a large section of the Kenyan public for how the judges clearly recognized the initiative for what it was – an attempt at rewriting the 2010 Constitution of Kenya with significant effect on Keyna’s democracy, separation of powers and the rule of law. The case had generated a wide spread public debate, not least because of the multiple ways in which the process of judicial review was brought closer to the people, including through live streaming the arguments and the decision. In this presentation, I discusses how this case represents a significant touchstone for comparative constitutional law scholars dealing with the theory and practice of unconstitutionality of constitutional amendments, the doctrine of basic structure and the meaning of ‘constituent power’ and popular initiative. I also highlight how the decision is paradigmatic of transformative constitutionalism in the way the judges center the ‘people’ of Kenya and their struggles within the larger political and constitutional history of the country. https://www.youtube.com/watch?v=H8ih-E-U_w8
