c. Menschenrechte in einzelnen Staaten
93. Die Bundesregierung nahm im Berichtszeitraum zu einer Reihe von Einzelfragen im Menschenrechtsbereich Stellung und gab insbesondere für die Europäische Union in den Vereinten Nationen Stellungnahmen ab.
Im Hinblick auf den andauernden Bürgerkrieg im ehemaligen Jugoslawien bezog sich der deutsche Vertreter im Namen der Europäischen Union vor der Generalversammlung auf den Bericht des Sonderberichterstatters zur Situation der Menschenrechte im Gebiet des ehemaligen Jugoslawiens, Mazowiecki:
"... We are extremely concerned at his findings of a dramatic resurgence of ethnic cleansing in areas under the control of Bosnian-Serb forces, the largest since the summer of 1992. Also the situation in the 'safe areas' continues to give cause for concern, since their inviolability continues to be only partially implemented. ... The European Union strongly believes that all those who perpetrate or authorize human rights violations or grave breaches of international humanitarian law should be held individually responsible. We welcome the beginning of the proceedings of the international tribunal on the former Yugoslavia."223 |
94. Die Europäische Union begrüßte die Abhaltung der ersten demokratischen Wahlen in Südafrika im April 1994, die der "degrading practice of apartheid" ein Ende gesetzt hätten. Die Europäische Union habe die Wahlen durch Entsendung von Wahlbeobachtern unterstützt.226
95. Die Fortschritte im Friedensprozeß im Nahen Osten begrüßte die Europäische Union, insbesondere den Abschluß des Gaza-Jericho-Abkommens und die Gründung der "Palestinian Authority in Jericho". Ebenso begrüßte sie die Fortschritte bei den Verhandlungen zwischen Jordanien und Israel mit der Zeichnung der Erklärung von Washington am 25. Juli 1994. Im Hinblick auf den Bericht des "special committee to investigate Israeli practices effecting the human rights of the Palestinian people and other Arabs of the occupied territories" führte der deutsche Vertreter für die Europäische Union, Österreich, Finnland, Norwegen und Schweden aus:
"The European Union reaffirms its attachment to adjust, durable and comprehensive settlement of the Palestinian question and the entire Arab-Israeli-Conflict on the basis of security council resolutions 242, 338 and 425 and within the agreed framework of the principles of international law. ..."227 |
"for the first time in history, opens the perspective for the realization of both the right to self-determination for the Palestinian people and the right of Israel to an existence in peace within secure and recognized borders. The European Union hopes that the remaining differences between the Israeli and Palestinian sides on the modalities of the first democratic elections in the Palestinian territories can be resolved soon. As a testimony of its commitment to this process, the European Union contributes substantially to the preparation of these elections through community and bilateral funds."228 |
96. Zur Situation in Haiti führte Deutschland für die Europäische Union aus:
"The European Union condemned the provisional investiture of Emile Jonassaint, President of the Supreme Court of Haiti, as President of the Republic by affection in the Haitian senate, as an unconstitutional act. The EU also condemned all measures taken by the de facto-authorities aimed at restricting public freedoms or ensuring the impunity of those responsible for the violation of human rights, as well as the expulsion of the international staff of the international civilian mission (MICIVEH)."229 |
"The international civilian mission jointly undertaken by the United Nations and the OAS underlines the commitment of the OAS to solving Haiti's grave problems. ... The European Union, Austria and Sweden support the efforts by the government of Haiti to establish an environment conductive to the organization of free and fair legislative elections to be monitored by the United Nations in co-operation with the OAS. We are prepared to assist the government in organizing these elections. ... The restoration of the constitutional order, the return of the legitimate authorities and the return of MICIVEH open the way for improving the human rights situation. In this respect we welcome the recommendation by the Secretary-General, reflected in this draft resolution to broaden the responsibilities of MICIVEH in order to contribute to strengthening of democratic institutions. ... The democratic government of Haiti now faces the difficult tasks of working for national reconciliation and of rebuilding a nation devastated by the abuses of its military rulers."230 |
"Against the global trend towards democratization, we are deeply concerned about instances in which the right to self-determination is denied through dictatorship, through electoral fraud, through lack of respect for electoral results or through the refusal to hold elections. We welcome that in Haiti, after three painful years of disregard of the democratically expressed wish of its people, the restoration of the constitutional order and the return of the legitimate authorities is now imminent. Thereupon, the European Union will assist Haiti in its difficult task of rebuilding civil life and the economy."231 |
97. Im Hinblick auf Ruanda erklärte der deutsche Vertreter für die Europäische Union:
"In Rwanda, the European Union is extremely concerned about the gross violations of human rights which have occurred especially since the outbreak of civil war after the tragic events of 6 April 1994. The Union strongly condemns the genocide, the crimes against humanity and against international humanitarian law perpetrated in that country. It is imperative that those accused of such crimes be brought to justice swiftly. We welcome the establishment by Security Council Resolution 955, of the International Tribunal on Rwanda. ... At the same time we appeal to the new Government in Rwanda to take further appropriate measures conductive to national reconciliation, including full respect for human rights."232 |
"The EU takes note of the formation of a new government of Rwanda that has announced its intention to work for national reconciliation, the rebuilding of the economy and the reintegration of refugees and displaced persons as well as for the establishment of peace and a democratic society in Rwanda. ... It is of importance that the government of Rwanda be truly representative of the whole of the population ..."233 |
98. Im Hinblick auf Burundi bedauerte die Europäische Union die tragischen Ereignisse vom Oktober 1993 und führte aus:
"The European Union has called upon those bearing responsibility in Burundi to do everything needed to stabilize the situation, first of all through settling the question of the democratic succession of the late President. ... . To this end, the EU fully supports the regional initiatives aiming at restoring peace and stability in Burundi. The European Union welcomes the meeting in Arusha of the Heads of State on 16 August 1994 and a possible enlargement of the OAU human rights monitoring team in Burundi."234 |
"Die Bundesregierung beabsichtigt in ihrem entwicklungspolitischen Programm in Burundi, sich schwerpunktmäßig bei der Förderung der Menschenrechte zu engagieren. Ausgangspunkt dafür könnte das 'centre des droits de l'homme' in Bujumbura werden, dessen Aktivitäten bisher mit 1,1 Millionen DM gefördert wurden."236 |
99. Die Situation im Sudan erfüllt die Europäische Union nach den Worten des deutschen Vertreters mit tiefer Besorgnis:
"Grave and widespread violations, including extrajudicial killings, summary executions, religious intolerance, enforced or involuntary disappearances, arbitrary arrest, torture, violations and abuses committed against women and children continue to take place according to the report of the Special Rapporteur... . In particular we call upon the Sudanese government to cease the deliberate and indiscriminate aerial bombing of civilian targets generating a flow of displaced persons within the Sudan and of refugees into neighboring countries."237 |
100. Besorgt bleibt die Europäische Union nach den Worten des deutschen Vertreters in der Generalversammlung über die Menschenrechtssituation in China:
"Our concern includes the administration of justice in China, notably the denial of rights to defendants, the extensive use of reeducation through labor camps, detention without trial for long periods and the arbitrary application and widespread use of the death penalty. The European Union urges the Government of the People's Republic of China to become a party to both International Covenants at the earliest opportunity and to protect internationally recognized individual human rights, such as the freedom of thought, conscience, expression and religion as well as the right to a due legal process. We believe that an effective guarantee of the civil rights to hold peaceful demonstrations and establish independent workers' representations would lead to a broader degree of participation of all in the political and economic decision-making process, which contributes to social stability."239 |
101. Im Hinblick auf die Operationen russischer Einheiten in Tschetschenien legte die Bundesregierung am 11. Dezember 1994 ihre Position wie folgt fest:
"Tschetschenien ist integraler Bestandteil der Russischen Föderation. Die Russische Föderation nimmt ihr souveränes Recht in Anspruch, auf ihrem gesamten Hoheitsgebiet die verfassungsmäßige Ordnung aufrechtzuerhalten bzw. wiederherzustellen. Die Bundesregierung geht davon aus, daß bei dem Vorgehen der Moskauer Zentrale die Menschen- und Minderheitenrechte respektiert sowie die Verhältnismäßigkeit der Mittel gewahrt werden."243 |
"Der Bundesminister des Auswärtigen hält grundsätzlich an der Auffassung fest, daß die Russische Föderation in den Europarat aufgenommen werden muß. Zum Zeitpunkt der Entscheidung müssen freilich alle Kriterien erfüllt sein, die der Europarat für die Mitgliedschaft festgelegt hat. Auf dem Höhepunkt des Tschetschenien-Konfliktes ist dies nicht der Fall."245 |
102. Die Bundesregierung nahm auf eine Kleine Anfrage im Deutschen Bundestag auch zu einem Gesetzesbeschluß der Staatsduma der Russischen Föderation Stellung, nach dem sich im Hinblick auf bestimmte Berufe Russen und bei der Einreise alle Ausländer zwangsweise einem HIV-Antikörpertest unterziehen müssen. Die Bundesregierung wies darauf hin, daß der Gesetzentwurf noch nicht in Kraft sei. Sie machte deutlich, daß, in Übereinstimmung mit den Empfehlungen der WHO, Reihen-Zwangstests als unwirksam abzulehnen seien. Sie führte weiterhin – auch im Hinblick auf die Respektierung der Menschenrechte von Menschen mit HIV-Infektion oder Aids – aus:
"Aufgrund einer Absprache im Rahmen der Europäischen Union hat der Botschafter der Bundesrepublik Deutschland in Moskau, zugleich im Namen der Europäischen Union, auf hoher Ebene im russischen Außenministerium, im russischen Gesundheitsministerium sowie im Föderationsrat demarchiert und unsere Einwände und Gesichtspunkte vorgetragen."246 |
103. Im Hinblick auf die Lage der Menschenrechte in der Türkei erklärte der deutsche Vertreter für die Europäische Union in der Generalversammlung:
"The European Union believes that in Turkey, notwithstanding efforts undertaken by the authorities, the human rights situation continues to give cause for concern, in particular with regard to the lack of freedom of the press, cases of torture and limitations on Trade Unions. However, we take note with interest of the democratization program which the government has presented on 18 May 1994 and believe that early implementation of its positive proposals to improve the respect for human rights, as well as granting access to a CSCE human rights mission and to certain human rights organizations would constitute important steps. The European Union acknowledges the difficult situation in the South East of Turkey and calls for political and peaceful solution. We have repeatedly condemned terrorist acts but insist that the fight against terrorism should be conducted with due regard to the rule of law and with full respect for international human rights standards."247 |
"Die Bundesregierung reagiert angesichts der gemeinsamen Erkenntnis, daß die Pressefreiheit Teil der Menschenrechte ist, auf Einschränkungen dieser Freiheit im Rahmen ihrer Menschenrechtsinitiativen. ... Die Bundesregierung setzt sich gegenüber der türkischen Regierung im allgemeinen, aber auch in besonderen Einzelfällen mit Nachdruck dafür ein, daß deutsche Medienvertreter in der Türkei frei und umgehend dort arbeiten können." |
"Das in der Frage angesprochene Urteil ist noch nicht rechtskräftig. Der Betroffene hat Berufung eingelegt. Die Bundesregierung hat daher keine Möglichkeit, insbesondere zugunsten eines ausländischen Staatsangehörigen in ein noch laufendes Gerichtsverfahren einzugreifen."249 |
104. Im eigenen Namen und für die Europäische Union nahm die Bundesrepublik Deutschland darüber hinaus zur Menschenrechtssituation in zahlreichen anderen Ländern Stellung.251
105. Hervorzuheben ist, daß sich Deutschland, auch im Namen der Europäischen Union, für Einzelpersonen einsetzte, die der Verfolgung ausgesetzt waren. Insoweit sind die Verhaftung des Gewerkschaftsführers und Politikers Abiola in Nigeria252, die Nobelpreisträgerin und Oppositionelle Daw Aung San Suu Kyi in Birma253, das Verfahren gegen den verhafteten Politiker Xanana Gusmâo in Ost-Timor254 sowie die Verfolgung der Schriftstellerin Taslima Nasreen in Bangladesh255 zu nennen. Die gegen Salman Rushdie im Iran ausgesprochene Fatwa, wurde als "flagrant breach of human rights and international law" bezeichnet. Weiterhin heißt es, sie begründe "an intolerable threat to him, but also to the publishers, translaters and others associated to his work".256
